The accident may be over in seconds. The dispute over what the vehicle is actually worth can last much longer. Since 2026, Washington has introduced a new tool to resolve certain valuation disputes between policyholders and insurance companies.

When a vehicle is so severely damaged that repairing it no longer makes economic sense, an insurer may declare it a total loss. But for a truck owner, that decision can raise an even more complicated question: How much is the truck actually worth?

In Washington, that question has taken on new significance in 2026.

A New Rule Starting in January 2026

Washington law requires automobile insurance policies that include first-party physical damage coverage, issued or renewed with an effective date on or after January 1, 2026, to include a right to an appraisal process for disputes between the policyholder and insurer over the Actual Cash Value (ACV) and the amount of loss.

The mechanism is established under RCW 48.18.620.

In simple terms, when a qualifying dispute occurs, the insured and the insurance company may each select their own appraiser. If the two appraisers cannot agree, the process allows for an umpire, an independent party who can help resolve the disagreement.

The Washington State Office of the Insurance Commissioner has also established a voluntary registry of umpires as part of the implementation of the new law.

What Is Actual Cash Value?

This concept can become crucial after a total loss.

The Washington State Office of the Insurance Commissioner (OIC) explains Actual Cash Value as the cost to replace damaged or lost property with comparable property, minus depreciation.

That means the amount an owner originally paid for a vehicle will not necessarily be the same amount recognized in a claim years later.

For a commercial truck, this can become especially important because of the value of the vehicle and the specific characteristics of each unit.

How Is the Value Determined After a Total Loss?

The OIC explains that when a vehicle is declared a total loss, the insurer must pay its Actual Cash Value.

To determine that amount, the insurer may use comparable vehicles available in the area or determine the cash value of comparable vehicles. If enough comparable units cannot be found near where the vehicle is normally kept, the search area may be progressively expanded.

There is also an important document that policyholders should know about: the total loss valuation report.

This report shows the information used by the insurance company to determine the vehicle’s value. The OIC notes that an insurer may not automatically provide it, meaning the policyholder may need to request it.

What If You Disagree With the Valuation?

This is where the 2026 change becomes particularly important.

The appraisal provision establishes a procedure for certain disputes involving the value of the vehicle and the amount of loss.

The law allows each party to select a competent and independent appraiser. If the two appraisers cannot agree, they may select an umpire. Washington has also established a process involving the Insurance Commissioner’s registry when the appraisers cannot agree on who should serve in that role.
